Terms of Service

These Terms of Service ("Terms") govern your use of Honk, a DMV practice-test study app for iPhone ("Honk," the "App," "we," "us," or "our"), operated by OneClick Commerce LLC. Please read them carefully. By downloading or using the App, you agree to these Terms.

1.Acceptance of these terms

By downloading, installing, or using Honk, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the App. If you are using Honk on behalf of a minor for whom you are responsible, you accept these Terms on their behalf.

2.What Honk is (and isn't)

Honk is an educational study aid that helps you prepare for a state driver's license knowledge ("written") test through practice questions, explanations, road-sign practice, and a practice exam simulator. Honk is not the official DMV test, is not a substitute for reading your state's official driver handbook, and does not issue or affect any license, permit, or official record.

3.Not affiliated with the DMV

Honk is an independent product. It is not affiliated with, endorsed by, sponsored by, or approved by any state Department of Motor Vehicles, department of transportation, or other government agency. All product names, logos, and trademarks are the property of their respective owners. Our practice questions are original works written to reflect the topics covered on real knowledge tests; they are not copied from any official exam.

4.No guarantee of passing

We work hard to keep Honk's content accurate and up to date, but driving laws, road signs, fines, and test formats change and vary by jurisdiction. We do not warrant that the content is complete, current, or error-free, and we do not guarantee that using Honk will result in passing any test. You are responsible for confirming current rules with your official state handbook and DMV. Honk is not legal or driving-safety advice.

5.Your license to use Honk

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices you own or control, for your own non-commercial study use. This license is also subject to Apple's Licensed Application End User License Agreement (the "Apple Standard EULA"), which applies to your use of the App.

6.Acceptable use

You agree not to:

• copy, reproduce, distribute, resell, or publicly post Honk's questions, explanations, or other content;
• reverse engineer, decompile, or attempt to extract the App's source code or content data, except as permitted by law;
• interfere with, disrupt, or place unreasonable load on the App or our content servers; or
• use the App for any unlawful purpose or in violation of these Terms.

7.Subscriptions & billing

Honk offers an auto-renewable subscription, Honk Plus, which unlocks the full App. Pricing and any free-trial terms are shown in the App before you purchase. Subscriptions are sold and billed through your Apple App Store account.

• Auto-renewal. Your subscription renews automatically at the end of each period unless you cancel at least 24 hours before the end of the current period. Your Apple account is charged for renewal within 24 hours before the period ends.
• Free trial. If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
• Managing & canceling. You can manage or cancel your subscription anytime in your Apple ID settings under Subscriptions. Deleting the App does not cancel your subscription.
• Refunds. Purchases are processed by Apple and are subject to Apple's refund policies. We do not directly process payments or issue refunds.

8.Intellectual property

The App, including its questions, explanations, text, graphics, the Honk name and duck mascot, and its software, is owned by OneClick Commerce LLC or its licensors and is protected by intellectual-property laws. Except for the limited license above, no rights are granted to you.

9.Disclaimers

THE APP AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ITS CONTENT REFLECTS THE MOST CURRENT LAWS OR TEST REQUIREMENTS.

10.Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONECLICK COMMERCE LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM FAILING A TEST, RELIANCE ON THE APP'S CONTENT, OR LOSS OF DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.

11.Changes to the App & terms

We may update, change, or discontinue features of the App at any time. We may also revise these Terms from time to time; when we do, we will update the "Last updated" date above. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

12.Termination

You may stop using Honk at any time by deleting the App. We may suspend or terminate your access if you violate these Terms or use the App in a way that could harm us or other users. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.

13.Governing law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles, except where a mandatory consumer-protection law of your place of residence applies. Nothing in these Terms limits any non-waivable statutory rights you have as a consumer.
